Terminology:

“Etse-Ada” refers to Etse-Ada Systems Ltd

“You”, “Your” refers to the user of the Etse-Ada Service

General Terms between Etse-Ada and the customer.

These terms govern the ongoing relationship between Etse-Ada and you, the user. This must be read and understood before registering or purchasing a subscription from Etse-Ada.

Services and Termination

Etse-Ada is an ongoing business analysis, systems analysis and digital marketing service that enables businesses to operate and grow efficiently as well as improve online visibility.

Registering and using the Etse-Ada service will lead to a legally binding agreement in line with the terms on this page and this can be terminated at any time by deleting your subscription by using the my account button in the top right of any website page when logged in. Alternatively, you can contact Etse-Ada through your projects email which we use to communicate with you to cancel your subscription and/or delete your account.

In the event that the client chooses to terminate the service, Etse-Ada will transfer all software hosted on a client's behalf to the client and the client will be responsible for its systems hosting costs after the termination of the client contract.

The user understands that Etse-Ada's Sites may be unavailable due to hosting service providers. In such an event, Etse-Ada will take reasonable steps to notify you where it becomes aware of any downtime. Etse-Ada will not be held liable for disruption to services that occur as a result of unexpected downtime.

The content on Etse-Ada's Sites are for informational purposes only and do not constitute legal advice.

Conditions for use of Etse-Ada Services

The user understands that Etse-Ada makes no guarantee whatsoever about the information provided on the site to the user while providing Etse-Ada services. While, Etse-Ada will take reasonable care to ensure that all information is accurate and relevant, Etse-Ada does guarantee the sufficiency or total reliability of that data as data on this website is not legal advice. Hence, Etse-Ada will not be liable for any losses or damage that may result directly or indirectly from use of the data provided on the site.

Intellectual Property

All data including data related to the projects and reports provided by Etse-Ada to you on this site are reserved as Etse-Ada’s intellectual property. These should only be used while the user is subscribed to the Etse-Ada service. Reproduction, downloading or printing off the data on this site is prohibited. Merely displaying this data to you, the user, will not amount to consent to reproduce the data in any format. This includes reproduction for commercial or non-commercial use.

Use of Customer data

These terms incorporate the Etse-Ada Privacy Notice as stated on the website and the user should check this privacy notice regularly as it shall not be subject to the notice periods stipulated in these terms.

Furthermore, the legal basis for processing your data on the site is Etse-Ada’s legal obligation under this agreement to provide services to you and to contact you regarding your account and subscriptions. Your data will only be used for the delivery of Etse-Ada’s service to you. When you wish to request what data Etse-Ada holds concerning you, do contact Etse-Ada with your request and that information will be provided to you within 14 days.

Please Note: Your Payments History such as invoices and receipts will be kept by Etse-Ada for at least six years to comply with our regulatory obligations.

Even after cancelling a subscription, your account data may not be deleted immediately, Etse-Ada will reasonably care to ensure that customers without an active subscription are deleted from the system. When your request deletion of your data will be deleted immediately upon your request when not on an active paid plan. If on a paid plan, requesting deletion of your data will not result in an entitlement to a refund and Etse-Ada will fulfil its contractual obligations to you until the end of your subscription period after which your account will be deleted.

Communication with Customers

Information concerning the user’s account, such as registration confirmation, login pass-codes, updates to the terms of agreement and suspension of account (by Etse-Ada) or cancellation of account (by consumer), will be communicated to the user through email immediately.

General communication to Etse-Ada users will be through newsletters for notifications on changes to services, terms or content related to your subscription(s). Users will be added to Newsletters automatically upon registration. Upon completing registration, users will be deemed to consent to being added to Etse-Ada's Newsletter list for the purposes of general account and subscription notifications in line with this agreement. Unsubscribing from such newsletters will mean you will not get these updates.

Security of User account and data

Etse-Ada takes reasonable steps to ensure the security of your data by ensuring data is encrypted at rest and in transit.

Also, users must ensure that no one else but them has access to their email account and other credentials needed to access their Etse-Ada account, this is to ensure that the user does not compromise the security of their account.

In the event that the consumer becomes aware of fraud and security breaches (including wrongful initiation of payment or accessing the user account by someone who is not the registered user), Etse-Ada must be notified of this through the contact page, whether it is the user or someone else who is at fault. Once this has been notified to Etse-Ada, there will be an investigation and interim measures such as the suspension of a user account for 7 business days until the issue is solved may be taken. Etse-Ada aims to resolve issues within 14 days and will update the customer via email of any updates or resolutions to the incidents.

Cost of Etse-Ada Services

Etse-Ada may charge a fee to the user depending on the plan and usage of the user’s organisation. Etse-Ada Fees are detailed on the Etse-Ada website - here.

After deactivating your subscription, you will lose access to data related to that subscription on the day your payment period expires.

Etse-Ada reserves the right to change the prices of its plans and will notify users at least six weeks in advance of any changes taking effect.

Abuse of Etse-Ada’s Services

Etse-Ada reserves the right to suspend a user’s account when it is deemed that the customer is abusing Etse-Ada resources.

Updates to these terms

These terms, and updates to it, bind Etse-Ada and the user until the user cancels their subscription with Etse-Ada.

Updates to these terms will be communicated to users at least 2 months before the change is to take place. Users will be notified of what date the changes will take place. By continuing to use Etse-Ada after these changes have taken effect, the customer is deemed to have consented to the changes.

Where changes are made to the contract due to new law or regulations and it is not possible to give the customer 2 months notice (for example, if such a law comes into force within less than 2 months of its enactment), then Etse-Ada will give the customer as much notice as is reasonably possible.
